BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

December 10, 2002

A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on December 10, 2002 at 8 p.m. at the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey.

Mayor Torre began the meeting and stated that the meeting complied with the Sunshine Law, due notice having been made to all members by personal service on January 1, 2002 and to The Observer, The Record and the Herald News on January 1, 2002.

ROLL CALL: Present: Mayor William J. Torre, Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Justin A. DiPisa, Councilman John Wassberg

Absent: Councilman Garrett R. Pepe, Councilwoman Marlene Verrastro

 

SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Mayor Torre led in the Salute to the Flag and Pledge of Allegiance.

BE IT RESOLVED that the claims and accounts amounting to $2,086,975.91 specified in the schedule hereto annexed, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

On a motion by Councilman DiPisa, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing Resolution was adopted.

On a motion by Councilman Wassberg, seconded by Councilman DiPisa, and unanimously carried, the foregoing Resolutions were approved. (Copies attached)


RESIGNATIONS: Coleen Lanzo from the Free Public Library Board of Trustees

On a motion by Councilman Wassberg, seconded by Councilman Heeren, and unanimously carried, the foregoing Resignation was accepted with regret.

 

 

APPOINTMENTS: Maryetta Saccomano to Free Public Library Board of Trustees

On a motion by Councilman Heeren, seconded by Councilman DiPisa, and unanimously carried, the foregoing Appointment was approved.




ORDINANCE (S) ON INTRODUCTION:

ORDINANCE NO. 1995:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO FIX THE SALARY AND COMPENSATION OF CERTAIN EMPLOYEES OF THE DEPARTMENT OF PUBLIC WORKS OF THE BOROUGH OF HASBROUCK HEIGHTS, NEW JERSEY, FOR THE YEAR 2003" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on December 30, 2002.

On a motion by Councilman Heeren, seconded by Councilman DiPisa, and unanimously carried, the foregoing Ordinance on Introduction was approved.

The DPW was congratulated on a good job on the recent snowstorm.

 

ORDINANCE INTRODUCED DURING CAUCUS:

During the Caucus, the meeting was open to introduce the following Ordinance:

 

ORDINANCE NO. 1996:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO AMEND SECTION 275-37 ENTITLED "ENFORCEMENT" OF ARTICLE X ENTITLED "ADMINISTRATION AND ENFORCEMENT" OF CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO ABOLISH THE SEPARATE OFFICE OF ZONING ENFORCEMENT OFFICER AND TO REDEFINE THE DUTIES OF OTHER BOROUGH OFFICIALS IN RELATION THERETO" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on December 30, 2002.

On a motion by Councilman Link, seconded by Councilman Wassberg, and unanimously carried, the foregoing Ordinance on Introduction was approved.

 

ORDINANCE(S) ON PUBLIC HEARING:

Mayor Torre opened the public hearing on Ordinance No. 1992, Ordinance No. 1993, and Ordinance No. 1994. As Ordinance No. 1992 had not yet been reviewed by the Planning Board, it was authorized to continue public hearing on that ordinance until December 30, 2002. As Ordinance No. 1993 and Ordinance No. 1994 had been published on December 5, 2002, public hearing would continue until December 17, 2002 for these ordinances. There being no one wishing to speak, the public hearing on these ordinances was closed.

 

ORDINANCE NO. 1992:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO FURTHER AMEND AND SUPPLEMENT SUBSECTION K IN SECTION 275-20 ENTITLED "REGULATIONS GOVERNING CERTAIN PRINCIPAL USES" AND SUBSECTION J IN SECTION 275-21 ENTITLED "REGULATIONS GOVERNING CERTAIN ACCESSORY STRUCTURES AND USES" OF CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO REVISE THE AREA TO BE CONTAINED WITHIN THE EXCEPTION TO THE PROHIBITION OF SEXUALLY ORIENTED ADULT ENTERTAINMENT AS AN ACCESSORY USE AND TO REVISE THE DISTANCE LIMITATION IN THAT AREA AND ALSO WITHIN THE AREA TO BE CONTAINED WITH THE EXCEPTION TO THE PROHIBITION OF SUCH USES A PRINCIPAL USES FROM 500 FEET TO 1,000 FEET" was continued on Public Hearing until December 30, 2002.

 

ORDINANCE NO. 1993:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO APPROPRIATE THE SUM OF $75,000.00 TO PROVIDE FOR THE ACQUISITION OF MOBILE COMPUTERS TO BE INSTALLED IN POLICE CARS FOR THE USE OF THE POLICE DEPARTMENT OF THE BOROUGH OF HASBROUCK HEIGHTS AND FOR THE ACQUISITION AND INSTALLATION OF PARTS REQUIRED TO UPGRADE CERTAIN OF THE TRAFFIC SIGNALS IN THE BOROUGH OF HASBROUCK HEIGHTS, TO PROVIDE FOR A DOWN PAYMENT THEREFOR IN THE SUM OF $3,750.00 FROM THE CAPITAL IMPROVEMENT FUND, AND TO AUTHORIZE THE FINANCING OF THE BALANCE OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $71,250.00 be continued on public hearing until December 17, 2002.

 

ORDINANCE NO. 1994:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO APPROPRIATE THE SUM OF $200,000.00 TO PROVIDE FOR THE RESURFACING OF CHARLTON AVENUE FROM TERRACE AVENUE TO BURTON AVENUE, FRANKLIN AVENUE FROM WOODSIDE AVENUE TO OAK GROVE AVENUE, HARRISON AVENUE FROM THE BOULEVARD TO WOOD STREET, HASBROUCK AVENUE FROM WILLIAMS AVENUE TO HILLSIDE AVENUE, HENRY STREET FROM ROUTE 17 TO TERRACE AVENUE AND MAC ARTHUR AVENUE FROM THE BOULEVARD TO THE BOUNDARY OF THE BOROUGH INCLUDING NECESSARY APPURTENANCES THERETO, TO PROVIDE THE SUM OF $10,000.00 AS A DOWN PAYMENT THEREFOR FROM THE CAPITAL IMPROVEMENT FUND, AND FURTHER TO AUTHORIZE THE FINANCING OF THE REMAINING COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $190,000.00 be continued on public hearing until December 17, 2002.

On a motion by Councilman Link, seconded by Councilman DiPisa, and unanimously carried, the foregoing Ordinances on Public Hearing were continued.

 

 

MISCELLANEOUS FROM PUBLIC:

Mayor Torre opened the meeting up to the public as per the Open Public Meetings Act legislation which was signed into law recently which requires that there be an opportunity for public comment at every meeting.

Tom Meli, 50 Central Avenue, thanked the Police, DPW, Borough Officials and anyone else involved in the success of the Christmas Parade. Mr. Meli and the Chamber of Commerce were also thanked for their hard work and success of the parade.

 

RECESS FOR CAUCUS:

Mayor Torre announced that the meeting would be recessed for Caucus.

 

ADJOURN:

There being no further business to be conducted by the Mayor and Council, the meeting was adjourned.
